These Terms of Service (“Terms”) are a binding agreement between you and BackDrop Studios LLC (“BackDrop Studios,” “we,” “us,” or “our”) governing your use of the Afterlane mobile application and related services (the “App” or “Afterlane”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
01 Eligibility
You must be at least 13 years old to use the App, and at least 18 years old (or the age of majority in your jurisdiction) to purchase a subscription. By using the App, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms. If you use the App on behalf of another person or entity, you represent that you are authorized to bind them to these Terms.
02 Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.
03 Acceptable use
Afterlane is a community built on trust and respect. You agree that you will not:
- Use the App to organize, promote, encourage, or facilitate illegal street racing, reckless or dangerous driving, sideshows, or any unlawful activity.
- Post content that is unlawful, harassing, threatening, defamatory, hateful, obscene, or that infringes the rights of others.
- Upload content you do not own or have the right to share, or that violates any third party's intellectual property or privacy rights.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Harass, stalk, threaten, or endanger other users, including misusing location features or check-in data.
- Attempt to access, tamper with, reverse engineer, or disrupt the App, its servers, or its security.
- Use the App for spam, scraping, or any unauthorized commercial purpose.
We reserve the right, but are not obligated, to review, moderate, and remove content, and to investigate violations of these Terms.
04 User content
You retain ownership of the photos, vehicle information, and other content you submit to the App (“User Content”). By submitting User Content, you grant BackDrop Studios a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely for the purpose of operating, providing, and promoting the App. You are solely responsible for your User Content and represent that you have all rights necessary to grant this license. We may remove any User Content that we believe violates these Terms or applicable law.
05 Subscriptions and billing
The App offers an optional paid subscription, Afterlane Pro, which unlocks additional features. Subscriptions are billed at the price displayed in the App (currently $7.99 per month) and may include a free trial period (currently 7 days) for eligible new subscribers.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period. If a free trial is offered and you do not cancel before it ends, your subscription will begin and you will be charged.
Payment and cancellation through Apple
Subscriptions purchased through the App are processed and billed by Apple through your App Store account, and are subject to Apple's terms. You can manage or cancel your subscription at any time in your device's App Store subscription settings. Deleting the App does not cancel your subscription.
06 Refunds
All fees are non-refundable except where required by law. We do not provide refunds or credits for partial subscription periods, unused time, or features you do not use.
Because subscriptions are sold through the App Store, refund requests for App Store purchases are handled solely by Apple in accordance with Apple's policies, and we have no ability to grant or deny those requests on Apple's behalf.
No refunds upon termination for violations. If we suspend, restrict, or terminate your account or subscription because you have violated these Terms or engaged in prohibited or unlawful conduct, you will not be entitled to any refund of any fees already paid, and any remaining or unused portion of your then-current subscription period will be forfeited. This applies regardless of how much of the billing period remains at the time of termination.
07 Suspension and termination
We may suspend or terminate your access to the App, your account, or any subscription at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or engaged in conduct that is unlawful or harmful to others or to the App. You may stop using the App and delete your account at any time. The sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and the refund provisions above — will survive.
08 Safety, meets, and assumption of risk
Afterlane is an organizational and social tool only. Any meet, drive, tour, event, or in-person interaction you discover, arrange, attend, or participate in through the App is undertaken entirely at your own risk.
BackDrop Studios does not host, sponsor, supervise, control, or vet meets, events, drives, locations, or other users, and is not responsible for the conduct of any user, whether online or offline. You are solely responsible for your own safety, for obeying all traffic and other laws, and for exercising good judgment. You agree that you assume all risks associated with attending meets, driving, traveling to locations, and interacting with other users, and that BackDrop Studios is not liable for any injury, death, property damage, loss, or other harm arising from those activities.
09 Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, secure, error-free, or that any content, location data, or information provided through the App is accurate or reliable.
10 Limitation of liability
To the maximum extent permitted by law, BackDrop Studios LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the App. Our total aggregate liability for any claims arising out of or relating to the App or these Terms will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars ($100).
11 Indemnification
You agree to indemnify, defend, and hold harmless BackDrop Studios LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the App, your User Content, your violation of these Terms, or your violation of any law or the rights of any third party.
12 Changes to the App and these Terms
We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13 Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in California, except where prohibited by applicable law.
14 Apple-specific terms
These Terms are between you and BackDrop Studios LLC only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15 Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms constitute the entire agreement between you and BackDrop Studios regarding the App and supersede any prior agreements.
